Planning Ops LLC respects the intellectual property rights of others and expects users of the Service (the Planning Ops platform, including Place & Finish Hub and Manpower Tracker) to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, this DMCA Policy describes how copyright owners can submit notices of claimed infringement and how users can submit counter-notices.
1.Designated Agent
Planning Ops LLC's designated agent for receipt of DMCA notices is:
Planning Ops LLC
c/o Registered Agents Inc
6650 Rivers Ave., Suite 100
Charleston, SC 29406, USA
Email: dmca@planningops.com
Alt. email: admin@planningops.com
Planning Ops LLC has registered the above agent with the United States Copyright Office. The current public listing is available through the Copyright Office DMCA Designated Agent Directory.
2.How to submit a takedown notice
If you believe that content on the Service infringes your copyright, you may submit a written notice to our DMCA Agent (contact information above). To be effective under the DMCA, your notice must include all of the following:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to be infringed (or, if multiple works on the Service are covered by a single notice, a representative list of such works).
- Identification of the material claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to allow us to locate it (URL, tenant identifier, screenshot, etc.).
- Information reasonably sufficient to allow us to contact you (address, telephone number, email).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.
Knowingly making a material misrepresentation that material is infringing may result in liability under 17 U.S.C. § 512(f), including for damages, costs, and attorneys' fees.
3.What happens after we receive a notice
Upon receiving a compliant DMCA notice, Planning Ops LLC will:
- Remove or disable access to the allegedly infringing material;
- Notify the affected user that the material has been removed and provide the user with a copy of the notice;
- Inform the user of the counter-notification procedure described below.
4.Counter-notices
If you believe that material you posted was removed in error or misidentification, you may submit a written counter-notice to our DMCA Agent. To be effective under the DMCA, your counter-notice must include all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Planning Ops LLC may be found), and that you will accept service of process from the person who provided the original notification or that person's agent.
Upon receipt of a compliant counter-notice, Planning Ops LLC will forward it to the original complainant. Unless the complainant files a court action seeking a restraining order against the user within 10–14 business days, Planning Ops LLC will restore the removed material.
5.Repeat-infringer policy
Planning Ops LLC will, in appropriate circumstances and at its discretion, terminate the accounts of users who repeatedly infringe copyrights. Generally, a user who receives three (3) DMCA takedown notices in a rolling 12-month period without successfully counter-noticing may have their account terminated. Termination may include loss of access to all Customer Data; you are responsible for exporting Customer Data while your account remains active.
6.Misuse
The DMCA process is intended to address copyright infringement claims, not general disputes about content. Misuse of the DMCA process — including filing knowingly false notices to harass a user or suppress lawful content — may itself give rise to liability under 17 U.S.C. § 512(f) and other laws. Planning Ops LLC reserves the right to seek remedies against parties who abuse the process.
7.Other forms of intellectual property
This policy addresses copyright infringement under the DMCA. If you believe content on the Service violates a trademark, right of publicity, or other intellectual property right, please contact us at admin@planningops.com with details. We review such notices on a case-by-case basis.
8.Updates to this policy
Planning Ops LLC may update this policy from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be communicated by email or by a notice in the Service.
